Strengthening Customs IPR Enforcement to Protect Enterprise Innovation
[Wang Hua]: A long way is ahead for IPR protection. It needs supervision over enforcement by administrative law-enforcing department as well as active actions of enterprises against infringement acts and their awareness of IPR protection. Now a lot of netizens have raised their questions. Let’s have a look at these questions. 04/25/2014 10:49:49
[Netizen: Hao Ren]: The export is experiencing a tough period now. Will the Customs campaign against infringements not impact enterprises’ exports? 04/25/2014 8:49:49
[Qiao Jinming]: To protect IPRs is one of the Customs’ legal obligations to protect legal trade, and it will not impact normal and legal import and export. In a rapidly developing economic society, a sound market order is the necessary. Only through playing by rules can the businesses win the customers’ respect and trust. The result of a disorderly market is that “bad money drives out good money” without any winner. The Customs protects IPRs and cracks down on infringement to rectify the market order and protect legitimate rights and interests of enterprises so as to create a good reputation for “made-in-China” products with more export opportunities. What we actually repress is illegal infringing enterprises, which bring out a false development. 04/25/2014 10:55:43
[Netizen: Enterprise in Yangjiang]: Hello! I’ m a salesman from a company in Yangjiang. Early March this year, our company tried to register a brand via the website of the GACC, but the system crashed frequently and we couldn’t complete the registration. What’s the matter? 04/25/2014 9:36:20
[Liu Yang]: In the previous period, the system was unstable and has caused some trouble. Now the system has been improved, you may try it again. If the system crashes again, you may call 12360. 04/25/2014 10:56:23
[Netizen: jest]: Will OEM-based products to export be regarded as infringement? 04/25/2014 9:26:54
[Qiao Jinming]: If IPRs are concerning in the export of OEM-based products, you should ask your customer to provide relevant IPR certificate, and you can ask the IPR holder to add your company to the GACC list of licensed enterprises or you may ask the IPR holder to provide related certificates in advance to the Customs for verification. 04/25/2014 10:56:37
[Netizen: Xia Zai]: Hello! I am interested in Customs IPR enforcement. The Customs has done a good job in this regard. But most of cases relate to international brands. For domestic brands and enterprises, what benefits can we get from these Customs measures? Thanks! 04/25/2014 8:44:12
[Liu Yang]: Thank you for care! I understand that the protection for national brands mainly concerns the protection of independent IPRs. According to law, the Customs gives equal protection to IPRs protected by China law without any discrimination. The Customs has been committed to protecting domestic independent IPRs for long, actively publicizing related laws and policies to domestic enterprises, and giving assistance in IPR protection in the process of their production, operation and import and export. In actual supervision, the Customs is also paying attention to any possible infringement on independent IPRs and taking forceful investigation and seizure on any infringements. In a word, the Customs is intensifying its efforts to protect Chinese IPRs and domestic enterprises have got benefits. If your company has your own IPR, you’d better register it with the Customs for our protection. In the future, we will take more effective measures to protect independent IPRs. In the process of import and export, for any question about the protection, please consult onsite Customs officers or call hotline 12360. Thanks! 04/25/2014 10:57:07.
[Netizen: anonymity]: Thank the Customs for protecting our trademark! 04/25/2014 9:37:55
